These Terms & Conditions apply to the use of the Encore Educational website and to purchases made through our website.

By using our website or placing an order with us, you agree to these Terms & Conditions.

1. About Us

Encore Educational is a family-run, independent educational furniture and resources supplier based in Middlesbrough, UK.

2. Website Information

We make every reasonable effort to ensure that the information, product descriptions, dimensions, images and prices displayed on our website are accurate.

However, colours and finishes may vary slightly from images shown on screen, and product specifications may occasionally change due to manufacturer updates.

We reserve the right to correct errors, update product information and make changes to products without prior notice.

3. Product Availability

All products are subject to availability.

Where a product is unavailable after an order has been placed, we will contact you as soon as reasonably possible and, where appropriate, offer an alternative, revised delivery date or refund.

Estimated delivery times are provided as guidance and may vary depending on the manufacturer, supplier, availability and delivery location.

4. Prices

All prices displayed on our website are in pounds sterling (£).

Unless specifically stated otherwise, prices shown to consumers include VAT where applicable.

Prices may change without notice. However, once we have accepted your order, the price applicable to that order will normally be the price confirmed at the time of purchase.

We reserve the right to correct pricing errors. If a product has been listed at an incorrect price, we will contact you before processing the order and give you the option to proceed at the correct price or cancel the order.

5. Placing an Order

When you place an order through our website, you are making an offer to purchase the products selected.

You will receive an order confirmation acknowledging receipt of your order. This does not necessarily mean that your order has been accepted.

An order is accepted when we confirm that the order has been accepted and/or the goods have been dispatched, whichever is applicable.

We reserve the right to refuse or cancel an order where there is a genuine reason to do so, including product availability, pricing errors, suspected fraud or payment issues.

6. Payment

Payment must be made using the payment methods available at checkout unless alternative payment terms have been agreed with Encore Educational in advance.

For approved business or educational customers with agreed account terms, payment must be made in accordance with the agreed terms.

We reserve the right to suspend further orders or deliveries where an account is overdue.

7. Delivery

We aim to deliver orders within the estimated timescale provided at the time of purchase.

Delivery times are estimates and are not guaranteed unless expressly agreed otherwise in writing.

Delivery times may be affected by manufacturer availability, supplier delays, courier delays, adverse weather, circumstances outside our reasonable control or other unforeseen circumstances.

Some larger furniture products may be delivered kerbside only unless a delivery and installation service has specifically been agreed.

It is the customer's responsibility to ensure that the delivery address is suitable for the goods being ordered and that there is reasonable access for delivery.

Where delivery requires specialist access, restricted access, stairs, narrow doorways or other unusual circumstances, customers should contact us before ordering.

Additional delivery charges may apply to non-mainland UK locations and certain areas, including parts of Scotland, the Highlands and Islands.

Any applicable delivery charge will be communicated before the order is processed where reasonably possible.

8. Delivery Inspection

Customers should inspect goods as soon as reasonably possible following delivery.

If goods arrive visibly damaged, please notify us as soon as possible and provide photographs where appropriate.

Signing for goods as damaged or noting any visible damage on the delivery paperwork is recommended where possible.

This does not affect your statutory rights.

9. Installation and Assembly

Where assembly or installation is included as part of an order, this will be carried out by Encore Educational or our appointed installation team.

Installation services may be subject to suitable access and site conditions.

The customer is responsible for ensuring that the installation area is clear and ready before our team arrives.

Additional charges may apply where significant preparation, removal of existing furniture, unusual access or additional work is required and this has not been included in the original quotation.

Where installation is not included, the customer is responsible for assembling and installing the products in accordance with the manufacturer's instructions.

10. Bespoke, Made-to-Order and Special-Order Products

Certain products are made to order, bespoke, customised or specially ordered to meet a customer's specific requirements.

These products may not be eligible for cancellation or return once production or manufacture has commenced, except where the goods are faulty, damaged or otherwise do not meet the agreed specification.

Where a product is non-returnable, this will be made clear to the customer before the order is confirmed where applicable.

11. Furniture and Product Specifications

Dimensions shown on the website are provided by the manufacturer or supplier and may be subject to minor manufacturing tolerances.

Images are for illustrative purposes and finishes, colours, handles, fittings or other details may differ slightly from those shown.

Customers should contact us before ordering if exact dimensions, colours, finishes or specifications are critical to their requirements.

12. Returns and Cancellations

For eligible online purchases made by consumers, you may have the right to cancel your order under the Consumer Contracts Regulations 2013.

Where applicable, you normally have 14 days from the day after receiving the goods to notify us that you wish to cancel, followed by a further 14 days to return the goods.

Goods must normally be returned in an unused and resaleable condition and, where reasonably possible, in their original packaging.

Customers may be responsible for the cost of returning goods unless the goods are faulty, incorrect or otherwise not as described.

For large or bulky furniture, we may be able to arrange collection. A reasonable collection charge may apply.

Business and Educational Customers

Different cancellation and return terms may apply to purchases made by schools, nurseries, businesses, organisations and other customers purchasing in the course of business.

Where a return is agreed for a business or educational customer, a minimum 20% restocking/collection charge may apply, depending on the product and circumstances.

Products that are bespoke, made to order, specially manufactured or otherwise identified as non-returnable cannot normally be returned unless they are faulty or incorrect.

13. Faulty or Incorrect Goods

If you receive goods that are faulty, damaged or not what you ordered, please contact us as soon as possible.

We may ask for photographs or other information to help us assess the issue.

Where a product is confirmed to be faulty or incorrect, we will work with you to provide an appropriate remedy in accordance with your statutory rights.

Depending on the circumstances, this may include repair, replacement, collection, refund or another appropriate solution.

14. Statutory Rights

Nothing in these Terms & Conditions affects your statutory rights under UK consumer protection legislation.

Where applicable, goods supplied to consumers must be of satisfactory quality, fit for purpose and as described.

15. Gift Cards and Promotional Offers

Promotional offers, discounts and gift cards may be subject to additional terms.

Where a promotional offer has specific conditions, these will be stated at the time of the promotion.

Gift cards cannot normally be exchanged for cash and may be subject to an expiry date or other conditions communicated when issued.

Encore Educational reserves the right to withdraw or amend promotional offers where reasonably necessary.

16. Website Use

You agree to use our website lawfully and responsibly.

You must not:

  • Use the website for fraudulent or unlawful purposes
  • Attempt to gain unauthorised access to the website or its systems
  • Introduce viruses, malware or other harmful material

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

Subject to this, Encore Educational will not be responsible for losses that are not reasonably foreseeable or for indirect or consequential losses arising from the use of our website or products.

We are not responsible for delays or failures caused by circumstances outside our reasonable control.

20. Events Outside Our Control

We will not be responsible for delays or failure to perform our obligations where this is caused by circumstances beyond our reasonable control.

These may include, but are not limited to:

  • Severe weather
  • Transport disruption
  • Supplier or manufacturer delays
  • Strikes or industrial action
  • Fire or flood
  • Power or telecommunications failures
  • Government restrictions
  • Natural disasters
  • Other events outside our reasonable control

We will make reasonable efforts to keep customers informed where such circumstances affect an order.
